Terms of use

1. General

These Terms of use (the “Terms”) govern the relationship between the FiBace service (fibace.com), operated by a sole proprietor (ФОП), details available on request: support@fibace.com (the “Platform”, “we”), and the individuals or legal entities who use the FiBace platform (the “User”, “you”). By signing up for the platform or using its services, you confirm that you have read these Terms and accept them in full. If you do not agree, please do not use the service.

2. The service and the User’s obligations

FiBace is a dashboard for owners of rental property in Ukraine: records of properties, tenants, leases and documents, rent payments, expenses and utilities. Only owners use the service; tenants have no accounts — they are records kept by the owner. The User undertakes to:

• Provide accurate information when signing up and while using the platform.
• Enter personal data of tenants and other people only with a lawful basis (for example, a lease or consent) and inform them about the processing, as the law requires.
• Not use the platform for unlawful activity or to violate the rights of third parties.
• Keep the sign-in details of their account confidential.
• Not attempt to gain unauthorised access to the platform’s systems.
• Not upload malware or content that breaks the law.

3. Plans and payment

• Plans. Free — 1 property, free of charge with no time limit. Pro — up to 5 properties, $20 a month. Business — up to 50 properties, $100 a month. Every plan is the full dashboard; paid plans also include data export in your profile (CSV, JSON, a ZIP archive with files). On any plan you can get a copy of your personal data free of charge on request — see section 10 of the Privacy policy.
• Currency. Prices are set in US dollars, and payment is charged in hryvnias: the amount is the dollar price at the official NBU exchange rate on the day the invoice is issued, rounded up to a whole hryvnia. The hryvnia amount may therefore change from month to month with the rate. You see the exact amount before you pay.
• Payment provider. Payments are taken through a payment provider (LiqPay, WayForPay or monobank), whose page opens when you pay. Card details are processed only by the provider.
• Auto-renewal. A subscription is taken out for one month and renews automatically. When you pay, the card is saved with the provider as a token, and 3 days before the end of the paid period we charge it for the next month. If the charge fails, we retry once a day and let you know by email. If no card is saved, we send you an email with a payment link.
• Grace period. If the next period is not paid by the end of the current one, the plan stays on for another 7 days. If there is still no payment by then, the account moves to Free.
• Changing plans. An upgrade takes effect right after payment; the unused part of the current paid period is credited towards the price. A downgrade takes effect from the next period and is possible only if your number of properties is within the new plan’s limit.
• After moving to Free. Your data does not go anywhere: all properties and records are kept and stay available, but you cannot add properties beyond the plan’s limit, and data export is no longer available.
• Cancellation. You can cancel your subscription at any time in the dashboard (Profile → Plan). The plan stays on until the end of the paid period, then the account moves to Free; there are no further charges. You can undo the cancellation until the period ends.
• Refunds. Cancelling does not automatically refund a period that has already started. Refunds (full or partial) are made on request to support@fibace.com through the payment provider, to the card used for the payment. A full refund of the current period moves the account to Free. This does not limit your consumer rights under Ukrainian law.

We reserve the right to change plan prices with at least 30 days’ notice to the User before the change takes effect.

4. Liability

The platform is provided “as is”. We do our best to keep the service running without interruption, but we do not guarantee that it is available 24/7. We are not liable for:

• Losses caused by the User’s improper use of the platform.
• Temporary unavailability of the service due to maintenance or force majeure.
• Actions of third parties, including the User’s tenants and counterparties.
• Loss of data caused by the User’s actions or by force majeure.

The User is responsible for the accuracy and lawfulness of the data they enter on the platform, including tenant data.

5. Privacy

The User’s personal data is collected, processed and stored in accordance with our Privacy policy and the laws of Ukraine, including the Law of Ukraine “On Personal Data Protection” and, where applicable, Regulation (EU) 2016/679 (GDPR).

For tenant data entered by the User, the User is the controller of the personal data, and FiBace processes it on the User’s behalf as a processor — only to store it and show it in the dashboard.

6. Intellectual property

All rights to the design, code, logos and content of the FiBace platform belong to their lawful owners. The User keeps all rights to the data and content they upload to the platform. By using the platform, the User grants us a limited licence to process their data solely to provide the service.

7. Termination

The User may stop using the platform and delete their account in their profile at any time; a paid subscription that renews must be cancelled first. We reserve the right to block the User’s account if these Terms or the laws of Ukraine are violated. After an account is deleted, its data is processed and deleted in accordance with the Privacy policy.

8. Changes to these Terms

We may update these Terms from time to time. We will announce material changes to the User by email or on the website at least 14 days before they take effect. Continuing to use the platform after the changes take effect means accepting the updated Terms.
